ATV's on Roadway?

What is your opinion on making ATV's legal to ride on the roadway for people 16 years old and older with a valid driver's license?

I am all for it if the drivers act like that they have some brains. I just wish that the people that drive the ATV on Walnut St. would just use theirs, mainly when there are children are present.

No it's not safe for them or for other drivers because they drive to fast and get out of control
with them. The dart across alleys, roads without looking first. There are too many young
children at risk during the summer with no school.
This will nothing but trouble for everyone!

I'm all for it. As long as: they carry proof of insurance, have fully operational head, brake and tail lights, follow all traffic laws and use common sense. I live on Walnut st too and have not seen any speeding ATV's but plenty of vehicle drivers running stop lights, and that includes those that live on Walnut and have children.

I think that kincaid is a little to small of a town to allow this as if you get groups of people doing this its going to cause alot of problems, i know that most of the people that do it now against the law ride just to get to the trails where they are going to ride. i can see opening up a certain set of streets that lead to this location which im sure everyone knows where that is.

You would be required to have a valid license, proof of insurance and have the golf cart inspected and registered the same as the ATV.

There has been alot of discussion if this is legal. Below is the state law allowing the Village to do this if they wished.

Illinois Vehicle Code - 625 ILCS 5, Section 11-1426
Operation of all-terrain vehicles and off-highway motorcycles on streets, roads and highways.

(a) Except as provided under this Section, it shall be unlawful for any person to drive or operate any all-terrain vehicle or off-highway motorcycle upon any street, highway or roadway in this State.

(b) Except as provided under subsection (c) of this Section, all-terrain vehicles and off-highway motorcycles may make a direct crossing provided:

(1) The crossing is made at an angle of approximately 90 degrees to the direction of the street, road or highway and at a place where no obstruction prevents a quick and safe crossing; and (2) The all-terrain vehicle or off-highway motorcycle is brought to a complete stop before attempting a crossing; and (3) The operator of the all-terrain vehicle or off-highway motorcycle yields the right of way to all pedestrian and vehicular traffic which constitutes a hazard; and (4) That when crossing a divided highway, the crossing is made only at an intersection of the highway with another public street, road, or highway; and (5) That when accessing township roadways in counties which contain a tract of the Shawnee National Forest, the accessing complies with rules promulgated by the Department of Natural Resources to govern the accessing. (c) No person operating an all-terrain vehicle or off-highway motorcycle shall make a direct crossing upon or across any tollroad, interstate highway, or controlled access highway in this State.

(d) The corporate authorities of a county, road district, township, city, village, or incorporated town may adopt ordinances or resolutions allowing all-terrain vehicles and off-highway motorcycles to be operated on roadways under their jurisdiction, designated by signs as may be prescribed by the Department, when it is necessary to cross a bridge or culvert or when it is impracticable to gain immediate access to an area adjacent to a highway where an all-terrain vehicle or off-highway motorcycle is to be operated. The crossing shall be made in the same direction as traffic.

(e) The corporate authorities of a county, road district, township, city, village, or incorporated town may adopt ordinances or resolutions designating one or more specific public highways or streets under their jurisdiction as egress and ingress routes for the use of all-terrain vehicles and off-highway motorcycles. Operation of all-terrain vehicles and off-highway motorcycles on the routes shall be in the same direction as traffic. Corporate authorities acting under the authority of this subsection (e) shall erect and maintain signs, as may be prescribed by the Department, giving proper notice of the designation.

After reading the law that allows us to have atv's on the road (with the proper city ordinance) does that make it possible for us to cross Rt 104 to go to the Post Office, grocery store etc?
Another suggestion is to require number plates, front and rear, to make it easier to report violators and for the officers to make identifications of the vehicles.

A drivers license is not required to operate an atv either but should be required if on village streets.

The Village ordinance would definitely make it mandatory that the driver have a valid driver's license and valid insurance. Also the board would have to decide if they wanted to use registration stickers or some type of plate.

Yes you would be able to cross State Route 104 but would not be able to drive down the highway.

Well, I guess this has become a dead issue. How about a public forum at a board meeting so the "for and against" can speak. Our trustees and mayor represent ALL the residents of Kincaid.

Mark I suggest you contact the Village Office and ask to be added to the minutes for that issue so that you can speak at the meeting.

I am for the use of golf vehicles, however, after seeing the behavior of several young men on ATV's when they were disallowed to participate in the labor day parade, I am most definitely against the use of ATVS. A young guy with his pregnant girlfriend on the back took off towards ridge street at an insane rate of speed. Not only was this unsafe for the two people aboard, but it was extremely dangerous for bystanders as well. Most of these owners also have ridiculously loud exhaust. I'm not against ATV's, I just don't trust the operators after seeing first hand how these vehicles were abused in public in front of pedestrians.

I think they should be allowed on streets. Laws should apply the same as motorcycles
